As a designer myself, I know the lengths that the company I write for, Starfire Design Studio, has gone to to revive a "dead" game. We certainly didn't wait around for a publisher; in fact one guy bought the rights from TFG so that he could self-publish and get out a product that TFG was sitting on. Second, it is not immediately obvious that the only way to make money from a game is to license only for-profit works. If you're Paramount and have a tremendous advertising budget as well as ongoing projects like TV shows, you can afford to tell amateurs you'd rather they not horn in. By contrast, if you have no advertising budget, no projects being developed, and no products in print, it night be a good idea to let some people work with your material in order to keep up interest. In addition, while I'm no expert on intellectual property, I'm still not clear on what basis a copyright owner would object to someone creating a work that is based on similar themes but doesn't actually incorporate copyrighted material. As I understand it, this is exactly the reason that companies are so assiduous about trade-marking titles, character names, and so forth. And as I recall, this was exactly what, for example, made TSR's case agaisnt WotC over the The Planar Order so weak, since WotC was just using AD&D mechanics, which couldn't be copyrighted. Now I DO support any owner protecting its rights, because if you don't do that you lose them, and I get the impression there are gray area, but it also bothers me when an owner enforces its rights overzealously, and claims rights with only a dubious basis on the principle that no one will be willing to challenge the claims because of fear of legal costs, because in doing so the owner is restricting the creative rights of others. Scott, This was (somewhat) what I was attempting to do- though not an 'unauthorized duplication'. It was my hope we could put up all Twilight: 2000 material, (on Tantalus's web site, so they could keep thier copyrights) and then, readers could write in and we could have a 'growth' of the game. People could suggest ideas for a development in the rules systems, write in with new equipment, weapons, ect- eventually a group could get together and put out a third edition of the game, ect ect. Tantalus, however, did not approve. For good reasons?
